Creator Terminal Agreement & Waiver
This Agreement & Waiver ("Agreement") is entered into by and between Creator Terminal ("Organization") and the undersigned participant ("Participant").
1. Acknowledgment of Risks
Participant acknowledges and understands that participation in Creator Terminal programs, workshops, and events involves inherent risks, including but not limited to physical injury, property damage, and other potential hazards. Participant agrees to assume all risks associated with participation.
2. Medical Treatment
Participant authorizes Creator Terminal to obtain medical treatment on Participant's behalf in the event of an emergency. Participant agrees to release and hold harmless Creator Terminal from any claims, demands, or causes of action arising out of or resulting from any medical treatment obtained.
3. Release and Waiver
Participant releases, waives, and discharges Creator Terminal, its directors, officers, employees, volunteers, and agents from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury that may be sustained by Participant or to any property belonging to Participant while participating in Creator Terminal activities.
4. Indemnification
Participant agrees to indemnify and hold harmless Creator Terminal, its directors, officers, employees, volunteers, and agents from any and all claims, demands, actions, or causes of action, including attorneys' fees and costs, arising out of or related to Participant's involvement in Creator Terminal activities.
5. Conduct
Participant agrees to abide by all rules, regulations, and instructions set forth by Creator Terminal. Failure to comply may result in removal from the program or event without refund.
6. Media Release
Participant grants Creator Terminal permission to use Participant's likeness in photographs, videos, or other media for promotional and educational purposes. Participant waives any right to compensation arising from such use.
7. Confidentiality
Participant agrees to maintain the confidentiality of any proprietary or confidential information disclosed during participation in Creator Terminal activities.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas.
9. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
10. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous understandings or agreements, whether written or oral, regarding the subject matter hereof.
